1. Interpretation and Definitions

For the purposes of this Privacy Policy the words of which the initial letter is capitalized have meanings defined herein. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural:

  • “Account” means a unique account created for You to access our Service or parts of our Service.
  • “Affiliate” means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • “Application” means the software program or the web application provided by the Company downloaded by You on any electronic device, named NeoDove.
  • “Company” (referred to as either “the Company”, “We”, “Us” or “Our” herein) means NeoDove Technologies Pvt. Ltd., a company registered under the Companies Act, 2013 having its registered office at 704-705, Sun Tower, Gandhi Nagar Mod, Rajasthan 302015. 
  • “Country” refers to the territorial jurisdiction of India.
  • “Device” means any device that can access the Service such as a computer, a mobile phone or a digital tablet.
  • “Personal Data” is any information that relates to an identified or identifiable individual.
  • “Service” refers to the Application and includes the host of services offered by the Company in association with its associates/channel partners/services providers engaged by the Company. 
  • “Service Provider” means any natural or legal person, including a company or individual engaged/employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used and which in any manner processes the data on behalf of the Company.  
  • “Third-party Social Media Service” refers to any website or any social network website through which a User can log in or create an account to use the Service.
  • “Usage Data” refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • “You” or “Your” or the “User” means the individual and/or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. The Company and the services offered by the Company

The Company is primarily a tele-calling CRM and sales engagement platform that helps small and medium businesses to monitor their telecalling teams and improve efficiency. 

The Company offers a range of services that helps significantly in contributing to the growth of our clients. Our services include:

  • Customer Engagement
  • Team Management
  • Reporting

3. Information the Company collects and shares

While signing up and/or using any of the Services offered by the Company, the Company may ask and collect from You (on case to case basis – depending on the service(s) being subscribed/opted for) any of the following information:

a) Personally identifiable information:  
  • Email address
  • First name and last name
  • Phone number
  • Address, State, ZIP/Postal code, City
  • Registration details, as applicable eg. GST, PAN etc.
  • Employee Detail
  • Any other information, as may be deemed essential in this regard.
b) Usage Data such as:
  • Your Device’s Internet Protocol address (e.g. IP address, type of mobile device.)
  • Browser type, browser version, mobile operating system
  • The pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
  • We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device. 
  • We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
  • Call and message log information like your phone number, calling-party number, receiving-party number, forwarding numbers, sender and recipient email address, time and date of calls and messages, duration of calls, routing information and types and volumes of calls and messages – depending upon the service availed of to make and receive calls or send and receive messages, as the case may be.

         Usage Data has collected automatically when using the Service.

c) Information from Third-Party Social Media Services

The Company allows You to create an account and log in to use the Service through the following Third-party Social Media Services:

  • Google
  • Facebook
  • Twitter

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service’s account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service’s account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

d) Information sharing with Third-Party Service Providers

The Company allows You to subscribe/opt for various services, enabled through association with trusted Third-Party Service Providers. By subscribing and/or opting for any of the services rendered through Third-Party Service Providers, You hereby consent and authorise the Company and/or its associates or Third Party Service Provider to collect, use, copy, reproduce, store and share the following information with its associated Third Party Service Provider(s), such as:  

  • Your personal details
  • Your Company details
  • Your Clients/customers list
  • Employee Details
  • Marketing material 
  • Potential customers details, as shared by you
e) Information sharing for other Legal requirements
Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy. 

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service

Please note that the Company uses various technologies to collect and store information, including cookiespixel tags, local storage, such as browser web storage or application data caches, databases and server logs.

NeoDove use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

4. Information the Company Stores, Data Security and location of the storage

The Company stores the information that we collect with unique identifiers tied to your account.

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. 

Personal Data: The Company will retain and use Your Personal Data for the period of your availing the services and/or such further period as may be required under law, if any, to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

Usage Data: The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.  

Data Processing: Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

Data security: The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

However, please note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

We build security into our services to protect your information. All the Company products are built with strong security features that continuously protect your information.  

  • We review our information collection, storage and processing practices, including physical security measures, to prevent unauthorised access to our systems on regular basis.
  • We restrict access to information collected and stored strictly on a need-to-know basis i.e. with our employees, contractors and agents who need that information in order to process it. All such persons are further subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

 

Location of Data: All NeoDove Technologies Pvt Ltd user databases are held and stored on Amazon Web Services (AWS) India.

5. Why the Company collects Your Information

We provide you a host of services, either through our own software or through third-party applications integrated with our software. By consenting to use a specific service, either from our software or an application of a third-party service provider, You are also consenting to authorise us and the concerned Service Provider for copying, sharing and/or reproducing in different formats of the information available with us. The information/data so procured, is used by the Company and/or the concerned Service Provider for any of the following purposes:

  • To provide and maintain our Service, including monitoring the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
  • To manage Your requests: To attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • Sharing with Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • Sharing with business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
  • Sharing with other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
  •  To research and analyse the usage trends and evaluation of further services to be offered.  
  • To evaluate your usage & needs and provide you options of other services to ease off/scale up your business further.
  • Receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request.
  • Enforce applicable Terms of Service, including investigation of potential violations.
  • Detect, prevent or otherwise address fraud, security or technical issues.

6. Export or Deletion of Your Information

The information once shared by You is retained by the Company for the period indicated in terms of this Privacy Policy. You cannot export or delete Your information once shared with us, except for reasons stated herein. 

Request for deletion of your personal data can be entertained by the Company only where there is no good reason for us to continue processing it or where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of deletion for specific legal reasons which will be notified to you, if applicable, at the time of your request.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us. You may withdraw your consent for further sharing your information with any other third party. The withdrawal of your consent shall however affect or result in withdrawal of certain services being made available to you. You shall not hold responsible the Company or its employees, or employees or agents or third-party Service Providers for any withdrawal or deficiency in service in such case of withdrawal of consent, whatsoever.

7. Requirement for availing our Services

The Company services are available to anyone above the age of 18 years. Acceptance of the terms and conditions and the privacy policy by any such user is a legally binding agreement between the Company and such user. 

A person over the age of 13 years and below the age of 18 years may also use our services, provided however, that the same is consented to by any parent of such proposed user. Acceptance of the terms and conditions and the privacy policy by any parent of any such proposed user is a legally binding agreement between the Company and the parent of such proposed user, thereby authorising the Company to use the data of the Parent and such proposed user in accordance with the terms of this Privacy Policy and terms of use of the services of the Company. 

We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent’s consent before We collect and use that information. 

8. Refund/Cancellation Policy

The Company follows “no cancellation” and “no refund” policy. The user may however be offered use of services on “trial basis”, on such terms as may specifically be provided separately for each service offered by the Company. After successful subscription of any of the service offered by the Company, such service shall continue to be in force for the term and manner, as specified in the terms and conditions of such service. You are advised to read the specific terms and conditions of each service before subscribing.

9. Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third-party’s site. We strongly advise You to review the Privacy Policy of every site You visit.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services. 

10. Changes to this policy

This Privacy Policy may be changed from time to time in view of the changing needs of the services being offered by the Company and/or requirement of any Law. Any significant change made to this Privacy Policy shall however prominently informed (including, for certain services, email notification of Privacy Policy changes). 

When you use our services, you’re trusting us with your information. We understand that this is a big responsibility and we work hard to protect your information. We will not reduce your rights under this Privacy Policy without your explicit consent. 

The changes made to this Privacy Policy over last one year can be accessed from the “archived versions” at any point.  

11. Your Legal Rights and responsibility

Under certain circumstances, you have rights under data protection laws in relation to your personal data. Your rights may include the right to access, correct, update, restrict or object to the processing of your personal data and withdraw the consent you have provided to us, subject to applicable data protection laws.
